1. ACCEPTANCE OF TERMS
These Terms of Service ("Terms") govern your access to and use of the website and services provided by AMEWIX. By accessing or using the Service, you agree to be bound by these Terms, our Privacy Policy, Refund Policy, Shipping Policy, and any additional policies referenced herein.
If you do not agree, do not use the Service.
2. ARBITRATION NOTICE
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes that qualify for small claims court, any Dispute between you and AMEWIX will be resolved through binding individual arbitration. By agreeing to these Terms, you and AMEWIX each waive the right to a jury trial and the right to participate in a class action.
You may opt out of arbitration within thirty (30) days of first agreeing to these Terms.
3. CHANGES TO THE SERVICE AND TERMS
We may update, modify, suspend, or discontinue any part of the Service at any time.
For changes that materially affect your rights, we will provide at least 30 days' advance notice.
4. THE SERVICE
AMEWIX is an online retail store offering innovative products to consumers worldwide. The Service is hosted by Shopify, which independently processes certain data.
5. ELIGIBILITY AND ACCOUNTS
You must be at least 18 years of age to use the Service.
You agree to:
- Provide accurate information
- Maintain security of your credentials
- Be responsible for all account activity
- Notify us of any unauthorized access
6. PRODUCTS, PRICING, AND ORDERS
- Prices, promotions, and availability subject to change without notice
- We reserve the right to limit quantities or refuse service
- Risk of loss for products passes upon delivery to the carrier
- Returns and refunds governed by our Refund Policy
7. PRODUCT REVIEWS
AMEWIX may display product reviews. We do not independently verify each review.
We prohibit fabricated, incentivized, or misleading reviews. Users may have accounts suspended for manipulating reviews.
8. USER CONTENT AND LICENSE
By submitting content to the Service, you grant AMEWIX a worldwide, royalty-free, perpetual, irrevocable, transferable, sublicensable license to use, reproduce, modify, publish, distribute, and create derivative works from your submissions.
9. INTELLECTUAL PROPERTY
The Service and its original content are owned by AMEWIX and protected by intellectual property laws.
The AMEWIX name, logo, and related logos are our trademarks.
10. PROHIBITED CONDUCT
You agree NOT to:
- Engage in unlawful, fraudulent, or abusive activity
- Upload malware or malicious code
- Scrape or harvest data from the Service
- Interfere with the security of the Service
- Violate intellectual property rights
- File false chargebacks or fraudulent claims
- Harass our staff or other customers
- Impersonate any person or entity
- Resell our products without authorization
Violation may result in account termination, permanent ban, and legal action.
11. PRIVACY
Your personal information is governed by our Privacy Policy.
12. CHARGEBACK POLICY
Filing a chargeback before contacting us is a violation of these Terms.
Customers MUST contact Support@amewix.com first to resolve any dispute.
Penalties for fraudulent chargebacks:
- Permanent ban from AMEWIX
- Liability for the disputed amount
- A $25 administrative fee per chargeback
- Collection costs and legal fees
- Reporting to fraud prevention databases
13. DISCLAIMER OF WARRANTIES
THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We disclaim all warranties including merchantability, fitness for a particular purpose, title, and non-infringement.
14. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, AMEWIX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
AMEWIX'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF:
(A) Amounts you paid to AMEWIX in the 12 months preceding the claim, OR
(B) One hundred U.S. dollars ($100.00)
15. DISPUTE RESOLUTION; ARBITRATION; CLASS ACTION WAIVER
15.1 Informal Resolution Required
Before filing any Dispute, you and AMEWIX agree to attempt informal resolution for at least 60 days. Send written notice to Support@amewix.com.
15.2 Binding Individual Arbitration
If not resolved informally, disputes shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
15.3 Class Action and Jury Trial Waiver
YOU AND AMEWIX AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN INDIVIDUAL CAPACITY, NOT AS A CLASS MEMBER OR REPRESENTATIVE PROCEEDING.
15.4 Opt-Out
You may opt out by sending written notice to Support@amewix.com within 30 days.
16. INDEMNIFICATION
You agree to indemnify and hold harmless AMEWIX, its affiliates, officers, directors, and employees from any claims arising from:
- Your use of the Service
- Your breach of these Terms
- Your violation of any law or third-party right
- Content you submit
- Disputes with third parties
17. TERMINATION
We may suspend or terminate the Service or your access at any time, for any reason, with or without notice.
18. GOVERNING LAW
These Terms are governed by the laws of the United States.
19. ELECTRONIC COMMUNICATIONS
You consent to receive communications electronically.
20. FORCE MAJEURE
AMEWIX shall not be liable for delays caused by events beyond our control, including:
- Natural disasters
- War, terrorism, civil unrest
- Pandemics
- Government actions
- Internet or utility failures
- Supplier or carrier disruptions
- Cyber attacks
21. GENERAL
- No waiver of any provision is continuing
- If any provision is unenforceable, the rest continues in force
- These Terms, with Privacy Policy, Refund Policy, and Shipping Policy, constitute the entire agreement
- You may not assign these Terms without our consent
